Personal Debt Collection Practices

If you have personal debt that you have failed to pay, chances are very good your account will eventually be turned over to a personal debt collector.  There are some things you should know about personal debt collection practices.

It is bad enough that you get harassing phone calls at all hours of the day and night, but when debt collectors call your friends and families, it can be pretty embarrassing.  Unless a court has given a debt collector permission to contact any third parties, it is illegal for them to do so.  If they do call your family or friends they are not allowed to reveal why they are looking for you, unless you are a minor.

Debt collectors are only supposed to call you between the hours of 8am and 9pm.  Debt collectors should not be calling you at 3am.  When a debt collector calls you, they must identify themselves.  A debt collector is only attempting to collect money owed.  They do not have the right to threaten you, swear at you, or abuse you in any way.  If any of these things happen, you should contact the FDPCA (Fair Debt Practices Act).  You may owe money, but you do not have to be subjected to rude and improper behavior on the part of debt collectors.

When taking on any kind of debt, you are responsible for paying that money back.  If for some reason you are not able to make your payments on time, you should always contact your creditor and try to come to an acceptable agreement for repayment.  It is best to avoid getting a call from a debt collection agency.

Debt Collection Agencies

Debt collection agencies are hired to collect on past due accounts by creditors.  They may be hired for personal or business loans.

Some debt collection agencies purchase delinquent accounts from creditors for a fraction of the cost.  The debt collection agency than pursues the debtor for the entire amount of the debt.

For the best chance of collecting on a delinquent account, it is best to turn the loan over as soon as possible.  The sooner the debt is turned over, the better the chance is of collecting what is owed.  The longer the debt goes unpaid, the less chance of it being paid back at all.  Once an account is past due 60 days, the chance of recovering the money due is only 50%.

A debt collection agency is called when a person is consistently late on making payments.  If you are unable to pay your bills, try working out some kind of payment arrangement with your creditor.  You do not really want a debt collection agency to step in and take over your debt.  Their job is to collect money from you, so they will pursue you until you have agreed to repay your debt.

You know if you are late on a payment, you will get a letter or phone call from your creditor.  You expect this, but most of us do not expect our accounts to be turned over to a debt collection agency.  People tend to take debt collection agencies seriously.  None of us want to have bad credit, so do what you can to keep up on all debts you owe.  You will glad you do.  You really do not want to have to deal with a debt collection agency.

Debt Collection

A debt collector is a person who works on behalf of a creditor.  As the name states, a debt collector works to collect money owed on a debt if the person is behind on their bills.

A debt collector is a professional 3rd party hired by the creditor.  They work to resolve issues that come up between creditors and consumers.  Most of the time, a mutual agreement for repayment of the debt is reached when a debt collector gets involved.  If an agreement can not be reached, the creditor may chose to take the case to court in order to collect the money they are owed.

Debt collection is not an easy job.  You are dealing with people who either have no intention of paying their bills, or with people who want to pay their debts, but due to emergency circumstances are no longer able to make their payments.

Most companies will do what they can to resolve debts by hiring a debt collector.  Most of the time people will pay the entire balance off when contacted by a debt collector.  Some people need to set up payment plans in order to pay off their balance.  The debt collectors job is to work with people in order to resolve the situation out of court.

Paying your bills on time, and making at least the minimum payments due each month is a good way to ensure you never have to deal with a debt collector.  The debt collector’s job is to find you and make arrangements for repayment of money owed.
